In New York State, a survival action is brought to recover damages for the personal injuries suffered by the decedent prior to the wrongful death. Los problemas que pueden impedir que el vendedor proporcione un título asegurable pueden ser una antigua hipoteca que nunca se descargó adecuadamente, un fallo monetario contra el vendedor o algo tan simple como un pago de impuestos atrasados o una factura de agua. Al hacer los arreglos para el cierre, el abogado obtiene información de pago de todas las hipotecas para que puedan ser pagadas. También preparamos ajustes para cosas tales como rentas, impuestos, cargos comunes de condominio o mantenimiento cooperativo. El abogado redacta la Escritura, la Declaración del Impuesto de Transferencia de Bienes Inmuebles del Estado de Nueva York, el Reporte de Transferencia de Bienes Inmuebles, cualquier declaración de impuestos locales de transferencia y, si corresponde, un Formulario de Pago de Impuesto sobre la Renta de Bienes Inmuebles No Residentes o Unidad Cooperativa. Después del cierre, el abogado redacta y envía una declaración de cierre detallada al vendedor que resume claramente la transacción y proporciona copias de los documentos más importantes. 

Para el comprador, el trabajo del abogado es asegurar que el comprador obtenga lo que busca, al precio y en los términos que ha ofrecido. Después de que el vendedor ha aceptado una oferta para la propiedad, el abogado se involucra para obtener una descripción general del trato de un corredor de bienes raíces y luego realizar una entrevista con el comprador. Se discuten las cosas como el nombre exacto del comprador y cómo pueden y podrían querer tomar el título. Si la propiedad es un condominio o una cooperativa, el abogado completará una descripción general del Plan de oferta y revisará los dos últimos estados financieros certificados de la asociación de condominio o corporación cooperativa. El abogado revisará el contrato de venta propuesto y los pasajeros preparados por el abogado para el vendedor. Una vez que se acuerdan los términos finales, el abogado se reunirá con los compradores para revisar el contrato de venta y los pasajeros que lleven consigo los documentos firmados, cobrar el cheque de pago inicial y transmitir el contrato firmado y el cheque del comprador al abogado del vendedor para el vendedor a firmar. 

Una vez que se devuelve el contrato firmado por el vendedor, los siguientes pasos son generalmente para solicitar un examen de título y formalmente solicitar una o más hipotecas. En el caso de una cooperativa, se ordena una búsqueda de derecho de retención en lugar de una búsqueda de título, pero los principios son los mismos. Una vez que la información recibida por el abogado, se realiza una revisión profunda del informe de título o búsqueda de gravamen por cualquier problema con el título, como cualquier violación emitida contra la propiedad. El abogado también ayudará y cooperará con el prestamista hipotecario para obtener la aprobación formal del préstamo, llamado compromiso hipotecario. 

Una vez que se emite el compromiso de la hipoteca, se programa un cierre. En preparación para el cierre, el abogado consultará con el abogado que representa al prestamista para conocer las ganancias netas del préstamo disponibles después de la deducción de los cargos del prestamista, y verificará la exactitud de los ajustes de cierre para cosas tales como rentas, impuestos, cargos comunes del condominio o mantenimiento cooperativo, y asesorar al comprador de los montos para llevar al cierre en fondos bancarios o certificados. 

Al cierre, el abogado consultará primero con el comprador para saber si hubo algún problema con la inspección final de la propiedad y, de ser así, revisará los ajustes que se realizarán al momento del cierre. Luego el abogado revisará y supervisará la ejecución del pagaré hipotecario y la hipoteca, o el acuerdo de seguridad en el caso de una cooperativa, y todos los documentos adjuntos requeridos por el prestamista. El abogado revisará la Escritura y supervisará la firma del comprador de la Declaración de Impuestos de Transferencia de Bienes Inmuebles del Estado de Nueva York, el Informe de Transferencia de Bienes Inmuebles y cualquier declaración de impuestos de transferencia local. Una vez que el prestamista emite los cheques correspondientes, se le paga a la compañía de títulos y se le entrega el saldo del precio de compra al vendedor, las llaves de la propiedad se le entregan al comprador y se cierra el cierre. Se proporcionará al cliente una declaración de cierre detallada de lo que ocurrió en el cierre. Una vez que la escritura se registra, se enviará al cliente.
